End User License Agreement

1. License Grant

Nix Dynamics ("we," "us," or "our") grants you a limited, non-exclusive, non-transferable, revocable license to download and use our mobile applications ("Apps") for your personal, non-commercial use, subject to these terms and conditions.

This license is for the sole purpose of enabling you to use and enjoy the Apps as intended by us.

2. Scope of License

2.1 Permitted Use

You may use the Apps on any Apple device that you own or control, in accordance with Apple's Usage Rules set forth in the App Store Terms of Service.

2.2 Restrictions

You agree NOT to:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Create derivative works based on the App
• Sublicense, rent, or lease the App
• Transfer the App to any third party
• Use the App for any unlawful purpose
• Remove, modify, or obscure any proprietary notices on the App
• Use the App in a manner that exceeds reasonable usage limits

2.3 Automatic Updates

The App may from time to time download and install updates from Apple. You consent to such automatic updates and agree to abide by them.

3. Ownership

The Apps and all content, features, and functionality are owned by Nix Dynamics and are protected by copyright, trademark, patent, and other intellectual property laws.

Nix Dynamics reserves all rights not expressly granted in this EULA.

4. User Data and Privacy

Your privacy is important to us. The collection and use of your personal information is governed by our Privacy Policy, which is incorporated into this EULA by reference.

By using the Apps, you consent to the collection and use of information as described in the Privacy Policy.

5. In-App Purchases and Subscriptions

5.1 Purchases

The Apps may include features that allow you to purchase goods or services. All purchases are final and non-refundable unless required by applicable law.

5.2 Subscriptions

If you subscribe to premium features, the subscription will automatically renew unless cancelled at least 24 hours before the end of the current period. Subscription fees will be charged to your Apple ID account.

5.3 Managing Subscriptions

You can manage or cancel subscriptions through your Apple ID account settings. Changes to subscriptions take effect at the start of the next billing cycle.

6. Third-Party Services and Materials

The Apps may include third-party materials or link to third-party services. We are not responsible for third-party materials or services and disclaim all liability relating thereto.

Your use of third-party services is governed by those third parties' terms and privacy policies.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOU USE THE APPS AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPS.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $1.00, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Nix Dynamics and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Apps or your breach of this EULA.

10. Termination

This EULA is effective until terminated. It will terminate automatically without notice if you fail to comply with any of its terms.

Upon termination, you must stop using the Apps and delete all copies from your devices.

Sections 3, 7, 8, 9, and 11 shall survive termination.

11. Governing Law

This EULA shall be governed by the laws of the State of Wyoming, without regard to conflict of law principles.

Any disputes shall be resolved in the state or federal courts located in Wyoming.

12. Apple Terms

You acknowledge that this EULA is between you and Nix Dynamics, not Apple. Nix Dynamics is solely responsible for the Apps and their content.

Your use of the Apps must comply with Apple's App Store Terms of Service.

Nix Dynamics, not Apple, is responsible for addressing any claims relating to the Apps, including product liability claims, claims under consumer protection laws, and claims that the Apps infringe third-party intellectual property rights.

Apple has no obligation to provide any maintenance or support services for the Apps.

13. Entire Agreement

This EULA constitutes the entire agreement between you and Nix Dynamics regarding the Apps and supersedes all prior agreements and understandings.
